Privacy Policy
This policy explains the privacy practices of NOYTER.com (“NOYTER“, together “we“, “us“, and “our“) with respect to noyter.com (“Website”) and other goods and services provided by NOYTER (“services”). This policy does not apply to the practices of third parties or any of our users who may collect or receive data in connection with their use of the Services.
This policy demonstrates our commitment to the European General Data Protection Regulation (“GDPR”) and the California Consumer Privacy Act (“CCPA”) to the extent we offer Services or monitor the activity of individuals in the European Union and California in the USA.
We handle your personal information to conduct business and provide services. By accepting our
Terms of Service, and in some jurisdictions accepting this policy, you agree that you have read and understood this policy, including how and why we use your information. If you do not want us to collect or process your personal information to the methods described in this policy, you should not use the Service.
Using the Services, you agree that NOYTER will use your information in the United States and any other country where NOYTER works. Please note that privacy laws and standards in some countries, including the authorities of the right to access your personal information, may differ from those that apply in the country in which you reside. We will share personal information only in those countries in which we are allowed by law to share personal information as described in more detail below.
Personal information.
In the process of providing the Services to you, we collect or receive your personal information directly from you, for example, during registration; indirectly from you based on your activity and interact with our Services or from the device or browser that you use to access the service; from our vendors and suppliers who help provide services with which you can interact, and from our third-party partners on advertising and marketing. Often you choose what information to provide, but sometimes we need some information to provide you with services. NOYTER uses the received and collected personal information in accordance with the purposes described in this policy.
To use our services, you will need to enter a valid email address. If you sign up, you will need to provide the name associated with your account. You can change this name in your account settings. You need to provide this information in order for us to provide services to you. Additional information, such as billing and payment method information (credit card number or PayPal email) may be required in order for us to provide a particular service.
For both buyers and sellers, NOYTER requires this information from you in order to provide services to you (to prevent fraud and abuse, to facilitate transactions between buyers and sellers) we may store credit card information for both billing and payment purposes.
The name associated with your account (which you can change in your account settings) will be publicly available and connected to NOYTER's activities.
We may collect and use information about you in order to feature you in marketing and advertising materials and campaigns, and to feature your listings, as provided for in our
Terms of Service.
NOYTER automatically receives and records information from your browser or on your mobile device when you visit a Web site or use a certain service functions, such as an IP-address or a unique device ID, cookie data, and the data about what pages you visit and how you interact with these pages to enable us to operate and provide services. This information is stored in log files and collected automatically. We may combine the information from your browser or on your mobile device with other information that we or our advertising or marketing partners collect about you, including different devices. This information is used to prevent fraud and to provide security services for the analysis and understanding of how services work for registered users and visitors, as well as for the personalized interaction for registered users and visitors.
NOYTER receives or receives information (such as an email address or IP address) about a person who is not yet a registered user of NOYTER (but a “non-registered user”) in connection with a particular NOYTER shows, for example, when non-registered users choose to subscribe to the NOYTER mailing list or a registered user invite an unregistered user to visit the website. Information about unregistered users is used only for the purposes disclosed when it is provided to NOYTER, for the purposes necessary for the operation of services or in cases where NOYTER has a legitimate interest, or to facilitate actions authorized by the user.
Communication.
Some messages from NOYTER related to the maintenance and to all users. You understand and agree that NOYTER may send you non-marketing e-mails, for example, relating to the transaction, your account, or changes in the security list. Examples of messages related services include email confirmation / welcome letter when registering an account, a notice of purchase or offer, service availability, changes in the basic functions, or functions, relaying messages from buyers and correspondence with our customer service team.
When you register an account, subscribe to a newsletter or provide us with your email address, you will receive a notification and consent (in some jurisdictions and situations with an additional unambiguous consent) to receive marketing e-mails and messages from us. You can unsubscribe from marketing emails or messages at any time using the opt-out link included in marketing emails or messages. Registered users and subscribers can also control which marketing emails or messages they receive from NOYTER through their account settings. Note that some changes in the settings of your account may come into force in a few days.
NOYTER is a marketplace. We offer several features that allow registered users to interact and communicate. Please use common sense if you choose to post, report or share your personal information with others through services. Please be aware that any personal information you choose to send there may be read, collected or used by others, or may be used to send you unsolicited messages. You are responsible for the personal information that you choose to publish through the services.
Transfer personal information.
The United States, the member states of the European Economic Area (“EEA”), and other countries have different laws. When your information is transferred from your home country to another country, the laws and regulations that protect your personal information in the country in which your information is transmitted may be different from those that apply in the country in which you live. The European Commission has adopted the standard contractual clauses (also known as the Model Regulations), which protect personal information transferred to countries outside Europe. We often use these Model Regulations when transferring personal information outside of Europe. NOYTER does not currently participate in the Privacy Shield program.
Security of personal information.
We follow generally accepted standards to protect the personal information provided both during the transmission time and after receiving it. Unfortunately, no method of transmission over the Internet or electronic storage method is 100% secure. Therefore, while we strive to protect your personal information, we can’t guarantee its absolute security. Your account information is password protected. It is important that you protect against unauthorized access to your account and information by choosing your password carefully and keeping your password and computer safe, for example, by logging out after using services. Retention of personal information.
NOYTER will only retain your information for as long as is necessary for the purposes set out in this policy, as long as your account is active (i.e. for the entire duration of your NOYTER account) or as long as it is necessary for provision of services. If you no longer want NOYTER to use your information to provide services, you can close your account. NOYTER will store and use your information to the extent necessary to comply with our legal obligations (for example, if we are required to keep your information in accordance with applicable tax and income laws), resolve disputes, enforce our agreements and comply with other descriptions in this policy. In addition, NOYTER sellers may also be required to store and use your information to fulfill their own legal obligations.
Please note that closing an account cannot free up your email address for reuse on a new account. We also keep log files for internal analysis. These log files are usually stored for a short period of time, unless they are used to maintain the security of the site, to improve its functionality, or we are legally obligated to keep them for longer periods of time.
Your responsibilities.
If you sell using our Services, you may receive and determine what to do with certain personal information. Your privacy responsibilities, including when you act as an independent data controller (who decides what personal data you collect and for what purpose you use it), are set out in our
Terms of Service.
Policy changes.
We may change or update this policy from time to time. If we deem the changes to be material, we will notify you by doing one (or more) of the following: posting the changes to or through services, or by sending you an email or message about the changes. We recommend that you regularly check and check for any updates.
